Welcome to NOWA. By accessing, registering for, or using our microblogging platform, mobile applications, map services, or other related functions (collectively, the “Services”), you agree to be bound by this contract. If you do not accept these terms, you must not use the Services.
1. Corporate structure & scope of service
- Independent Subsidiary: NOWA is a digital platform created and engineered by Celebriffy Technologies. However, NOWA operates and is managed as a strictly autonomous, independent subsidiary of its parent company. Celebriffy Technologies acts solely as the creator of the initial technological infrastructure and assumes no operational, editorial, or direct legal liability for the daily activities, moderation, or content hosted on NOWA.
- Purpose of the Platform: NOWA is designed and operates exclusively as a platform for Local, National, and International News and Current Affairs. The purpose of the Services is to allow users, journalists, creators, and media outlets to broadcast, share, and interact with public interest information, reports, and chronicles of global or community events in real-time.
2. Intellectual property & DMCA copyright policy
You retain your intellectual property rights over the Content you submit or post on the Services. However, by posting Content, you grant us a worldwide, non-exclusive, royalty-free, and sublicensable license to use, copy, reproduce, process, adapt, modify, publish, transmit, and distribute such Content in any and all media.
Digital Millennium Copyright Act (DMCA) safe harbor
In accordance with the DMCA (17 U.S.C. § 512), NOWA has implemented the following procedure for reporting copyright infringement. If you believe that your copyrighted work has been copied in a way that constitutes copyright infringement, please submit a written notice to our Designated Copyright Agent:

Your Takedown Notice must include:
- A physical or electronic signature of the copyright owner or authorized representative.
- Identification of the copyrighted work claimed to have been infringed.
- Identification of the material that is claimed to be infringing and its exact URL on NOWA.
- Your contact information (address, telephone number, and email).
- A statement that you have a good faith belief that use of the material is not authorized.
- A statement that the information in the notification is accurate, under penalty of perjury.
3. Third-party content & defamation policy
NOWA functions exclusively as an interactive computer service provider and public forum for third-party news and current affairs.
- Section 230 Immunity: Pursuant to Section 230 of the Communications Decency Act (47 U.S.C. § 230), NOWA and its parent company, Celebriffy Technologies, are not considered publishers or speakers of any information provided by another content provider. We are legally immune from liability regarding defamatory, slanderous, false, libelous, or offensive statements posted by users.
- No Arbiter of Truth: Given our nature as an open news forum, users may post breaking news, citizen journalism, or editorial pieces. NOWA does not pre-screen, validate, or verify the factual accuracy of information shared by third parties.
- Pre-Suit Notice Requirement (Florida Statutes Chapter 770): To the extent any user-generated content or official platform notation is legally challenged, and without waiving our Section 230 immunity, any prospective plaintiff must strictly comply with Chapter 770 of the Florida Statutes. This requires providing NOWA with explicit, written pre-suit notice specifying the allegedly false or defamatory statements at least five (5) days before filing any legal action.
4. Governing law & jurisdiction
- Governing Law: These Terms, your relationship with NOWA, and any dispute arising out of or relating to the Services shall be governed exclusively by the federal laws of the United States and the laws of the State of Florida, without regard to its conflict of law principles.
- Exclusive Forum: Any legal suit, action, or proceeding arising out of or related to these Terms or the platform MUST be instituted exclusively in the federal or state courts located in Miami-Dade County, Florida. You and NOWA hereby irrevocably submit and consent to the personal jurisdiction of such courts.
- Statute of Limitations: In alignment with Florida law, you agree that any claim or cause of action arising out of or related to the use of NOWA must be filed within two (2) years after such claim or cause of action arose, or be forever barred.
5. Limitation of liability and parent company immunity
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, NOWA, ITS AFFILIATES, DIRECTORS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, REVENUES, DATA, OR USE.
- Immunity of Celebriffy Technologies: Any legal action, claim, lawsuit, or dispute arising from the use of NOWA’s Services must be directed solely and exclusively against the operating entity of the independent subsidiary NOWA.
- Waiver: The User expressly waives any right to exercise legal action, collective or individual, against Celebriffy Technologies, acknowledging that said entity is completely disassociated from the management of news content, moderation, and the user database of this platform.
- Financial Cap: In no event shall the total liability of NOWA exceed the amount of $100 USD or the net amount you paid to NOWA in the past six months.
